1. Agreement and provider
These Terms of Use (“Terms”) are an agreement between you and Blue Alpine GmbH (“Blue Alpine,” “we,” “us,” or “our”) governing your use of the Longevity Coach iPhone application, related content, and this website (together, the “Service”). By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter into this agreement. These Terms supplement the Apple Standard End User License Agreement (“Apple EULA”). If these Terms conflict with the Apple EULA for the licensed app, the Apple EULA controls.
2. Wellness and medical disclaimer
Healthspan Scores, Wellness Age estimates, confidence ranges, trends, plans, and educational content are general wellness information. They may be incomplete, inaccurate, or unsuitable for your circumstances. They do not predict lifespan, guarantee an outcome, or replace a physician, physiotherapist, dietitian, mental-health professional, or other qualified professional.
Consult a qualified healthcare professional before starting or changing exercise, nutrition, sleep, or wellness practices—especially if you are pregnant, have a medical condition or injury, take medication, experience symptoms, or have concerns about your health. Stop an activity and seek appropriate care if you feel pain, dizziness, shortness of breath beyond ordinary exertion, or other concerning symptoms. Do not use the Service for emergencies; contact local emergency services.
3. License and acceptable use
Subject to these Terms and the Apple EULA, Blue Alpine grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the app on Apple-branded devices that you own or control for your own non-commercial purposes.
You agree not to:
- copy, resell, sublicense, rent, distribute, or commercially exploit the Service except where law expressly permits;
- reverse engineer, bypass security or subscription controls, probe for vulnerabilities, or interfere with operation of the Service, except where such restriction is prohibited by law;
- use the Service to violate law, another person’s rights, or Apple’s applicable rules;
- misrepresent an estimate or score from the Service as a clinical test, diagnosis, or professional certification; or
- use automated methods to extract a substantial portion of the app’s research, learning, or habit library.
4. Plans, scores, estimates, and research
The Service generates plans and estimates using the information available to it, including information you enter and, if you choose, Apple Health data. Results depend on the completeness and accuracy of those inputs. You are responsible for reviewing a recommendation against your abilities, limitations, environment, equipment, and professional advice.
Research summaries and citations are provided for education. Science and public-health guidance can change, and individual studies have limitations. We may revise, add, or remove content as evidence evolves. A citation does not mean that the cited organization endorses Longevity Coach.
5. Premium subscriptions
Longevity Coach may offer weekly and yearly auto-renewing Premium subscriptions. The price and billing period shown in the Apple purchase sheet at the time of purchase control. Payment is charged to your Apple Account after confirmation.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period.
- Apple may charge your account for renewal within 24 hours before the current period ends.
- You can manage or cancel in iOS Settings → your name → Subscriptions or through Apple’s subscription management page.
- Deleting the app does not cancel a subscription.
- Refunds, billing disputes, free trials, and price changes are handled under Apple’s Media Services terms and applicable law.
Premium features may evolve, but during an active paid period we will not intentionally remove substantially all paid functionality without a reasonable remedy required by applicable law.
6. Apple Health, local data, and permissions
Apple Health access is optional and read-only. You control which categories the app can read and can revoke permission in the Health app. The Service must not be used to make medical or insurance decisions, and Health data must not be used for advertising.
You are responsible for your device, backups, exported files, and the accuracy of information you enter. Deleting local data may be irreversible. Our handling of information is described in the Privacy Policy.
7. Intellectual property and feedback
The Service—including its design, software, scoring presentation, text, illustrations, branding, and curated content—is owned by Blue Alpine or its licensors and protected by intellectual-property laws. Third-party research, names, and trademarks remain the property of their respective owners.
If you voluntarily send feedback, you allow us to use it without restriction or compensation to improve the Service, provided we do not publicly identify you without permission.
8. Availability, changes, and termination
We may update, improve, suspend, or discontinue features for maintenance, security, legal, technical, or product reasons. We do not promise that the Service will always be available, error-free, or compatible with every device or future operating-system version.
You may stop using the Service at any time. We may suspend access if you materially violate these Terms or misuse the Service. Subscription cancellation and any refund rights remain governed by Apple and applicable law.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Blue Alpine disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not warrant any specific wellness, fitness, healthspan, or longevity outcome.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.
10. Limitation of liability
To the maximum extent permitted by law, Blue Alpine and its directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of opportunity, or loss of profits arising from the Service.
Where liability cannot be excluded, our aggregate liability arising from the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or CHF 50. These limits do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or liability that applicable law does not allow us to limit.
11. Apple-specific terms
You and Blue Alpine acknowledge that these Terms are between you and Blue Alpine, not Apple. Blue Alpine, not Apple, is responsible for the app and its content, maintenance and support, and claims relating to the app, subject to the Apple EULA and applicable law.
Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as provided by its terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the terms relating to the licensed app.
You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on a United States government prohibited or restricted-party list.
12. Governing law and disputes
These Terms are governed by Swiss law, without regard to conflict-of-law rules. Courts in Zürich, Switzerland will have jurisdiction, except where the mandatory consumer law of your country gives you the right to bring a claim in another court or under another law.
Before filing a claim, please contact us and give us a reasonable opportunity to resolve the concern informally.
13. Changes and general terms
We may update these Terms to reflect changes to the Service or legal requirements. The latest version will remain at this URL with a revised effective date. If a change materially affects your rights, we will provide notice where required.
If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, sale, or similar transaction, subject to applicable law.
